1) Conditions of Use 

Welcome to the BROUG’s website, which operates under the tradename Broug Ateliers Ltd (the “Site”).

Except as otherwise noted, these Terms and Conditions (the “Terms”) govern your use of the Site. Please read them carefully, since your visit to the Site—and activities you partake in herein, including placing an order, serve as your agreement to be bound by them. In other words, your use of the Site is subject to your compliance with these Terms. If you do not agree to abide by them, you should not access or use the Site, or place any orders herein.

We reserve the sole right to change the Site and these Terms at any time. We’ll post these changes here, and suggest you review these Terms each time you access the Site.

2) Electronic Communications 

When you visit the Site or send emails to us, you are communicating with us electronically. In doing so, you consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications provided in this way electronically satisfy any legal requirement that such communications be in writing. BROUG’s will send related information, promotions and special discounts to the email address provided by its customers unless a customer indicates he/she no longer wants to receive these emails communications (opt-out) by sending an e-mail to info@ broug.com.

3) Copyright 

All of the content you see on the Site, including, but not limited to, page headers, images, illustrations, graphics, audio clips, video clips and text (collectively, the “Content”) is the exclusive property of BROUG’s and/or is subject to trademark, service mark, trade dress, copyright and/or other intellectual property rights or licenses held by Broug Ateliers Ltd, by any affiliate or third party that’s licensed or assigned their rights, interests and/or materials to us.

You may download, print and store selected portions of the Content, but only if (1) you use any such copies of the Content only for your own personal and non-commercial use, (2) you do not copy or post the Content on any network computer or broadcast the Content in any media and/or in any form or format, (3) you do not modify or alter the Content in any way, or delete or change any copyright or trademark notice, and (4) you properly credit all intellectual property rights. No right, title or interest in any downloaded or copied materials are transferred to you as a result of any copying, downloading, or other activity. BROUG’s reserves complete title and full intellectual property rights in all Content. Except as noted above, you may not copy, download, reproduce, modify, publish, distribute, transmit, transfer or create derivative works from the Content without first obtaining the express written permission of Broug Ateliers Ltd.

4) Your Membership Account 

If you use the Site and create an account, you are responsible for maintaining its confidentiality and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use our website only with involvement of a parent or guardian. BROUG’s and its associates reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

5) Reviews, Comments, E-mails, And Other Contents 

You may post reviews, comments, and other content: and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of “spam.” You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. BROUG’s reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.

6) Indemnification 

You agree to defend, indemnify and hold BROUG’s harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of the Site. You agree to indemnify BROUG’s from all claims of third parties including intellectual property right claims related to a name, logo, brand, design or any other form of intellectual property you provide to us.

7) Disclaimer 

The Site and the Content are provided on an “as is” basis without warranties of any kind, either express or implied, including, without limitation, warranties of title or implied warranties of merchantability or fitness for a particular purpose. You acknowledge, by your use of the Site, that your use of the Site is at your sole risk, that you assume full responsibility for all costs associated with all necessary servicing or repairs of any equipment you use in connection with your use of the Site, and that BROUG’s shall not be liable for any damages of any kind related to your use.

8) Terms Governing Purchase And Delivery Of Product 

General: For the purposes of this section only, “you” refers to a customer who purchases products from BROUG’s. When you purchase a product from us, you agree to pay the agreed-upon price. This price, including delivery fees and taxes, if any, is to be paid in full at the time your order is placed. BROUG’s reserves the right to cancel the order and reimburse possible payments, if the goods ordered are not available. In this case, we will inform you immediately of the unavailability of the goods.

Address changes: In case order or address information needs to be changed after your order is placed, BROUG’s will make a reasonable effort to adjust the order or address; nevertheless, if costs have already been incurred, you will have to either accept the original order at the original price or pay additional charges to remake and/or ship the goods.

Delivery time: We will use our best efforts to create and deliver the product(s) you order within 1-2 weeks; however, delivery time is not guaranteed. BROUG’s is not liable and will not pay for claims for any direct or consequential loss caused by delivering the product 3 weeks or more after the order date.

Quality issues: It is your responsibility to notify BROUG’s of any issue with your product within 7 days after delivery and, if applicable, send us corresponding photo(s). BROUG’s will work with you to meet your expectations regarding the quality of your products. If we are not able to meet these quality expectations, we offer a full refund. See next section for our return policy.

Money Back Guarantee: Unless the customer has approved the proof of product, BROUG’s offers a full refund upon request by the customer. The conditions for a refund are: (i) You report the issue and/or make a money back request within 7 days after delivery of the product. (ii) You return the products back to BROUG’s, paying for all return shipping charges. (iii) We fund the full amount within 7 days after receiving the return product(s). If we have furnished you with a proof of your product (note that this “proof” may consist of a product sample, a product photograph, or other format), and you have approved this proof, this Money Back Guarantee does not apply to your order.

9) Applicable Law & Venue 

You are doing business with Broug Ateliers Ltd (Business address: 44 Westborough Drive, Halifax HX27QL, United Kingdom). By visiting the Site, you agree that the laws of the United Kingdom, without regard to principles of conflict of laws, will govern the Terms and any dispute of any sort that might arise between you and Broug Ateliers Ltd or its associates. Any dispute relating in any way to your visit to the Site or to products you purchase through the Site shall be submitted to a court in the United Kingdom.
